Warranty Policy

Definitions

  • “You”, “your”, “customer”, “buyer” mean: The individual or organization identified as the purchaser on the original sales invoice.

  • “Empowered PC”,  “Company”, “we”, “us”, and/or “our” refer to Computer Upgrade King, LLC, doing business as Empowered PC.

Non-Branded Warranty Coverage. Products sold by Empowered PC that are not built or modified by Empowered PC are covered by the original manufacturer's warranty, not the Empowered PC Limited Hardware Warranty.

Empowered PC provides 30 days of phone and online support from the date of purchase. If a covered hardware defect is reported within 30 days of delivery, Empowered PC will cover eligible shipping costs within the Contiguous United States (lower 48 states), subject to warranty verification.

Branded Warranty Coverage. All new Empowered PC custom-built desktop systems and third-party OEM computers upgraded or modified by Empowered PC include a Limited Lifetime Service Policy and an applicable 3-Year Limited Hardware Warranty, subject to the terms and exclusions outlined in this policy.

Limited Lifetime Service Policy. The original purchaser receives free labor for eligible repairs, phone support, and online technical support for the lifetime of the system. Coverage applies to the original system configuration and subsequent upgrades purchased from and installed by Empowered PC. The policy is non-transferable and subject to the exclusions and limitations outlined below.

Lifetime Service Policy Limitations: For purposes of this policy, “lifetime” refers to the serviceable life of the original system. Coverage remains available while the system can reasonably be serviced using compatible replacement components and supported diagnostic tools.

The Lifetime Service Policy does not guarantee the continued availability of replacement parts, software compatibility, or support for obsolete hardware or operating systems. If a system can no longer be reasonably serviced, Empowered PC will advise the customer of available repair or upgrade options.

The Lifetime Service Policy covers eligible labor and technical support only. Replacement parts outside their applicable hardware warranty periods, shipping charges, and non-warranty services may incur additional costs as outlined in this policy. Eligible repair labor remains free when compatible replacement parts are purchased from Empowered PC.

Customer Modifications, BIOS Settings, and Warranty Limitations. Empowered PC systems are professionally configured, assembled, and tested before shipment to ensure hardware compatibility, stability, and proper thermal performance.

The Limited Lifetime Service Policy does not include installation, configuration, troubleshooting, or technical support for customer-installed or third-party components, unauthorized BIOS/UEFI modifications, or unsupported hardware configurations.

Empowered PC does not recommend or provide technical support for customer-initiated changes to core hardware components or factory-configured BIOS/UEFI settings unless expressly authorized in writing by Empowered PC Support. Such modifications include, but are not limited to:

  • BIOS/UEFI Settings: Changes to CPU power limits, voltage settings, clock speeds, memory configurations, fan curves, thermal limits, or other performance settings.

  • CPU and Motherboard: Replacement, removal, installation, or modification of the CPU or motherboard.

  • Cooling System: Replacement, removal, or modification of CPU coolers, cooling components, or cooling configurations.

  • Power Supply: Replacement or modification of the power supply, power connections, or related wiring.

  • Overclocking and Undervolting: Changes to factory-configured operating parameters that may affect stability, power consumption, or thermal performance.

Customers must disclose customer-installed hardware, component replacements, and BIOS/UEFI changes when requesting warranty service. Empowered PC may require customers to restore the original hardware configuration and factory-validated BIOS settings, or reinstall or provide original components, when reasonably necessary for warranty diagnostics.

Empowered PC reserves the right to inspect and diagnose the system to determine whether a reported failure was caused by customer modifications, improper installation, or unsupported configurations.

Failures, instability, overheating, or damage caused by such modifications are excluded from warranty coverage for the affected components, including other components damaged as a result. Customer-installed or third-party components are not covered under the Empowered PC Limited Hardware Warranty. However, customer modifications do not automatically void warranty coverage for unrelated defects in otherwise covered components.

If diagnostic testing determines that a reported issue resulted from customer modifications, improper installation, or unsupported configurations, applicable diagnostic, repair, replacement part, and shipping charges may apply. Empowered PC will advise the customer of applicable charges and obtain authorization before performing billable services.

Customers are encouraged to contact Empowered PC Support before installing third-party hardware, updating BIOS/UEFI firmware, changing factory-configured settings, or replacing core components. Our team can assist with compatibility verification and available professional upgrade services.

Operating Systems and Software Support

Empowered PC's Limited Lifetime Service Policy and Limited Hardware Warranty primarily cover the original hardware configuration supplied and installed by Empowered PC. Operating system and software support is subject to the following limitations:

  • Windows 11: Empowered PC provides technical support for Windows 11 when originally installed by Empowered PC, limited to issues related to the factory-installed configuration and hardware functionality. Support does not include third-party applications, customer-installed software, ongoing operating system administration, or modifications made after delivery.

  • Windows Server: Empowered PC may offer Windows Server installation on select systems. Empowered PC does not provide Windows Server operating system technical support. Customers are responsible for operating system configuration, administration, troubleshooting, drivers, updates, and software support.

  • Linux (including Ubuntu): Empowered PC may offer Linux installation on select systems. However, not all hardware manufacturers provide Linux-compatible drivers or support, and certain components or features may not function as expected. Our willingness to install Linux should not be interpreted as a guarantee of full hardware compatibility. Empowered PC does not provide Linux operating system technical support. Customers are responsible for Linux configuration, troubleshooting, drivers, updates, and software support.

  • Customer-Installed or Modified Operating Systems: Customers may install, replace, upgrade, or modify their operating systems without automatically voiding the Limited Hardware Warranty. However, Empowered PC is not responsible for compatibility issues, driver conflicts, software instability, or other problems resulting from customer-installed or modified operating systems.

  • Hardware Warranty Coverage: Installing or using an operating system other than the one originally supplied by Empowered PC does not, by itself, void the Limited Hardware Warranty. Eligible hardware defects remain covered under the applicable warranty terms. However, failures or damage determined to have been caused by unsupported software, improper configurations, or customer modifications are excluded from coverage. Refer to the Customer Modifications, BIOS Settings, and Warranty Limitations section for additional details.

Customers are responsible for maintaining their operating systems, drivers, applications, software licenses, security updates, and data backups unless otherwise expressly agreed upon in writing.

3-Year Limited Hardware Warranty

Empowered PC Custom-Built Systems: All new Empowered PC custom-built desktop systems include a 3-Year Limited Hardware Warranty covering all original hardware components supplied and installed by Empowered PC, except where a different warranty period is expressly specified below. Coverage is subject to the exclusions and limitations outlined in this policy.

Third-Party OEM Systems: For third-party OEM computers upgraded or modified by Empowered PC, the 3-Year Limited Hardware Warranty applies only to the components upgraded or installed by Empowered PC. All remaining original OEM components retain their applicable manufacturer's warranty.

Warranty Start Date: The 3-Year Limited Hardware Warranty begins on the original date of purchase, regardless of the shipment or delivery date, and remains in effect for three years, except where a different warranty period is expressly specified.

For purposes of this warranty, the date of purchase is the date Empowered PC accepts and confirms the customer's order, including orders placed under approved credit terms. The purchase date will be documented in Empowered PC's order records and will determine the applicable warranty period.

Component-Specific Warranty Exceptions The following components have warranty periods that differ from the standard 3-Year Limited Hardware Warranty:

  • Liquid/Water Cooling Components: 1-year warranty covering parts and labor.

  • Special-Order Components: Covered for the duration of the original manufacturer's warranty.

  • AMD Graphics Cards: 2-year warranty covering parts and labor.

  • Monitors: 1-year warranty covering parts and labor.

Warranty Shipping Responsibilities.  The following shipping terms apply to all eligible claims under Empowered PC’s limited Hardware Warranty, including claims involving components with different warranty periods:

  1. If an issue covered by the warranty should arise within the first 30 days of delivery, Empowered PC will cover to and from shipping costs within the Contiguous United States (lower 48 states).

  2. If an issue covered by the warranty arises after the first 30 days of delivery, the customer will be responsible for shipping the product to Empowered PC. Empowered PC will cover return shipping for eligible warranty repairs within the Contiguous United States (lower 48 states) for up to one year from the original date of purchase. After one year from the original date of purchase, the customer will be responsible for shipping costs in both directions.

To Request Warranty. Email support@EmpoweredPC.com within the applicable warranty period. Provide your invoice number, product serial number, and reason for the warranty request. Customers must also disclose any hardware upgrades, component replacements, BIOS/UEFI changes, overclocking, undervolting, or third-party repairs performed after receiving the system.

This information is necessary to accurately diagnose reported issues and determine applicable warranty coverage.

Our support representatives will attempt to diagnose and resolve the problem over email, phone, and remote link. As part of the diagnostic process, Empowered PC may request information regarding hardware configurations, BIOS/UEFI settings, or modifications made after delivery. Customers may be asked to provide photographs, system information, or other relevant diagnostic details to help identify the cause of the reported issue. If we determine that the problem is with the product(s) or part(s) of the product(s), we will then either:

  • Send you a replacement part(s) (while authorizing the cost(s) of the part(s) on a valid credit card and capturing said funds if replacement part(s) are not returned within 30 days).

  • Return the product(s) to us for repair.

If Empowered PC determines that a product requires inspection or service, a Return Merchandise Authorization (RMA) number may be issued. An RMA authorizes the return of the product for evaluation and does not constitute approval of warranty coverage. RMA numbers are valid for ten (10) days. Any Product returned to Company that does not have a valid RMA number visible on the outside of the package will be refused. Product that is not defective will be returned to the customer after shipping charges have been collected.

Non-Warranty Diagnostics and Repairs. If inspection or diagnostic testing determines that a reported issue is not covered by the warranty, or no covered hardware defect is found, applicable diagnostic and shipping charges may apply. Empowered PC will disclose applicable charges before performing billable services and obtain customer authorization before proceeding with non-warranty repairs.

If the customer declines the repair, the customer remains responsible for applicable diagnostic charges previously authorized and return shipping costs. Empowered PC is not obligated to release or ship the product until applicable charges have been paid. Any unclaimed product will be handled in accordance with applicable law.

Return and Refund Policy. Customers may request a return within 30 days from the date of delivery. No return of merchandise will be accepted without first obtaining an RMA number issued by Empowered PC. Customers must provide evidence of the purchase date, invoice number, product description, model and serial numbers, and reason for the return, exchange, or refund.

Empowered PC reserves the right to review, approve, or deny requests for returns, exchanges, refunds, or damage claims in accordance with this policy. Return requests made after 30 days from delivery may be considered at Empowered PC's sole discretion. However, no return, refund, credit, or exchange will be permitted after 45 days from the date of delivery for laptop and desktop computer systems or component purchases.

If approved, products returned unused, unopened, complete, and in original new and resalable condition, including all original packaging and accessories, are eligible for a refund of the product purchase price. Original shipping and handling charges are nonrefundable.

Products returned with broken or removed factory seals, signs of use, cosmetic damage, missing accessories, or missing or damaged retail cartons or internal packaging materials may be subject to restocking fees or refund deductions, as determined by Empowered PC based on the overall condition, completeness, and resale value of the returned merchandise.

Opened software, promotional items, game vouchers, services, and products with engraving, laser etching, customer logos, or other permanent personalization are not eligible for refund or return. Software with a printed license or sealed packaging may not be returned if the seal or sticker has been broken, or if the software has been downloaded or activated.

All returned products must have the RMA number prominently displayed on the shipping label, with return freight prepaid by the customer. Returns must include all original packaging, internal packing materials, components, accessories, manuals, and a copy of the invoice. Products must be securely packaged and delivered to Empowered PC in undamaged condition.

All shipping and handling charges are nonrefundable. Empowered PC reserves the right to refuse or reject returned merchandise that fails to meet the requirements of this policy.

Products with covered hardware defects remain eligible for applicable warranty service after the return period expires.

Shipping the Product. Ship the Product(s) back to Company in their original or equivalent packaging and accompanied by copies of purchase receipts. Replacement packaging can be requested from us for a nominal fee. Clearly mark the RMA number on the outside of the carton. All returns for exchange or refund must be complete with all components, manuals, cables, warranty cards, and static bags, just as you received it. If the Product is not returned in its entirety, you will be charged for the missing items. Company is not responsible for any damage to the product that occurs while the product is in transit from you to Company, regardless of sufficient or negligent packaging.

Repair and Replacement of Your Product or Parts. Company owns all parts removed from repaired products. Company uses new and reconditioned parts made by various manufacturers in performing warranty repairs and building replacement products. We will replace defective parts with the same or comparable parts at no cost. Comparable replacement parts are components that provide substantially equivalent functionality and performance, as reasonably determined by Empowered PC. Replacement parts may differ in manufacturer, model, appearance, or specifications and may be new or reconditioned. Any other part replacement that is different from the original configuration must be purchased at cost. If Company repairs or replaces a product, the warranty term is not extended. Company will not reimburse Customer for any repairs or replacements performed by anyone other than Company or anyone not authorized by Company.

For International Customers. The Limited Lifetime Service Policy and applicable Limited Hardware Warranty extend to eligible products shipped outside the Contiguous United States (lower 48 states), provided the products qualify for coverage under the Branded Warranty Coverage section of this policy and the original purchase can be verified through Empowered PC's sales records.

International customers are responsible for all shipping and freight charges in both directions, including shipping products or defective components to Empowered PC and receiving repaired or replacement products or parts. Customers are also responsible for all applicable customs duties, import and export fees, VAT, taxes, brokerage fees, and other associated charges.

Empowered PC is not responsible for arranging or reimbursing repairs, diagnostics, or services performed by third-party or local service providers unless expressly authorized in writing by Empowered PC before such services are performed.

All international warranty claims remain subject to the applicable warranty terms, exclusions, and service procedures outlined in this policy.

This warranty does not cover. Empowered PC's Limited Hardware Warranty does not cover damage, defects, failures, or conditions outside the scope of the warranty, including, but not limited to, the following:

  • Accidental Damage or Misuse: Accidents, abuse, misuse, neglect, improper handling, improper installation, or use inconsistent with the instructions accompanying the product.

  • External Causes: Electrical problems, power surges, improper power connections, acts of third parties, lightning, fire, water, flooding, weather conditions, natural disasters, or other events beyond Empowered PC's control.

  • Unauthorized Repairs or Modifications: Damage, defects, or failures caused by unauthorized repairs, alterations, customer-installed hardware, improper component installation, or changes to factory-configured BIOS/UEFI settings. Refer to the Customer Modifications, BIOS Settings, and Warranty Limitations section for additional details.

  • Third-Party Hardware and Software: Damage, failures, instability, or compatibility issues caused by software, hardware, accessories, or components not supplied or installed by Empowered PC.

  • Improper Maintenance: Damage or failures resulting from failure to follow product instructions or perform required preventive maintenance, including applicable data backups and other recommended maintenance procedures.

  • Shipping Damage: Damage occurring during return shipments or subsequent shipments after the original delivery. Damage occurring during the original shipment is subject to Empowered PC's applicable shipping damage procedures.

  • Excluded Products: Promotional items and non-Empowered PC branded accessories that are not expressly covered under the applicable warranty.

  • Product Identification and Purchase Eligibility: Warranty coverage applies only to products originally purchased directly from Empowered PC or Computer Upgrade King, LLC, including purchases made through our authorized sales channels. Products with missing, altered, or mismatched serial numbers, or products whose original purchase cannot be verified, may be denied warranty service.

Business Purchases and End Users: When a business purchases systems from Empowered PC for installation or use by its customers, warranty coverage remains with the original purchasing business and does not automatically transfer to the end user. The purchasing business is responsible for coordinating warranty claims with Empowered PC unless otherwise authorized by Empowered PC. Direct communication or technical assistance provided to an end user does not constitute a transfer of warranty coverage.

Outstanding Balances: Empowered PC reserves the right to suspend warranty service for any product or order with an outstanding balance until all amounts due for that product or order have been paid in full.

Other Exclusions: The exclusions listed above are not exhaustive. Empowered PC reserves the right to evaluate warranty claims on a case-by-case basis and deny coverage for conditions not expressly listed when inspection, diagnostic findings, or other available evidence establishes that the issue falls outside the warranty's stated coverage. Empowered PC may request additional information, documentation, or testing to determine warranty eligibility.

Warranty Evaluation: Empowered PC reserves the right to inspect and diagnose products to determine whether a reported failure qualifies for warranty coverage. Customer modifications do not automatically void warranty coverage for unrelated defects in otherwise covered components.

Protect Your Own Data and Software. Customers are solely responsible for maintaining and backing up all data, files, software, applications, licenses, passwords, and system configurations stored on or associated with their products.

Before submitting a product for warranty service, repair, replacement, or technical support, customers are responsible for independently backing up all important data and software and, where appropriate, removing confidential, sensitive, or proprietary information.

Warranty diagnostics, repairs, component replacements, operating system reinstallation, storage device formatting, or other service procedures may result in the partial or complete loss of data, software, settings, or configurations. Customers acknowledge and accept that all data and software may be permanently lost during or following service.

Empowered PC is not obligated to back up, preserve, recover, restore, or transfer customer data or software, or to remind customers to perform backups. Any assistance with data backup, transfer, or recovery is provided at Empowered PC's discretion and does not guarantee the preservation or successful recovery of any data.

Customers authorize Empowered PC to perform diagnostics and service procedures reasonably necessary to evaluate or repair the product, including accessing the operating system, resetting software configurations, reinstalling software, formatting storage devices, or replacing storage components when necessary.

To the fullest extent permitted by applicable law, Empowered PC shall not be liable for loss, corruption, deletion, or inadvertent disclosure of data or software; loss of files, licenses, or configurations; loss of time; inconvenience; business interruption; or any resulting direct, indirect, incidental, special, or consequential damages arising from product failure or warranty service, including where such losses are alleged to result from Empowered PC's acts, omissions, or negligence.

Customized and Engraved Product Policy. Products customized with engraving, laser etching, customer logos, or other permanent personalization are considered custom-made items and are not eligible for return or refund under Empowered PC's standard return policy. The standard 30-day return period does not apply to these products.

Customized products remain eligible for applicable hardware warranty coverage. However, Empowered PC does not guarantee the preservation, restoration, or replacement of engraving, laser etching, logos, or other personalization during warranty service or repairs. Replacement of defective components, panels, chassis, or other parts may result in the removal, alteration, or loss of the original customization. Empowered PC is not responsible for the cost of restoring or reproducing such customization.

Limitation of Liability. BUYER'S SOLE AND EXCLUSIVE REMEDY AND COMPANY'S SOLE LIABILITY FOR LOSS OR DAMAGE ARISING FROM THE PURCHASE OR USE OF A PRODUCT SHALL BE LIMITED TO REPAIR OR REPLACEMENT OF THE PRODUCT AT COMPANY'S SOLE DISCRETION.

IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY LOSS OF USE, REVENUE, ANTICIPATED PROFITS, BUSINESS OPPORTUNITIES, BUSINESS INTERRUPTION, LOSS OR CORRUPTION OF DATA OR SOFTWARE, COSTS OF SUBSTITUTE EQUIPMENT OR SERVICES, OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR CONNECTED WITH THE SALE, USE, OPERATION, OR INABILITY TO USE PRODUCTS PURCHASED FROM COMPANY.

TO THE EXTENT PERMITTED BY LAW, COMPANY MAKES NO OTHER REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED TO THE EXTENT PERMITTED BY LAW. TO THE EXTENT SUCH IMPLIED WARRANTIES CANNOT BE DISCLAIMED, THEIR DURATION SHALL BE LIMITED TO THE DURATION OF THE APPLICABLE LIMITED WARRANTY.

IN NO EVENT SHALL COMPANY'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY THE PURCHASER FOR THE PARTICULAR PRODUCT GIVING RISE TO THE CLAIM. MULTIPLE CLAIMS ARISING FROM THE SAME PRODUCT OR TRANSACTION SHALL NOT INCREASE THIS LIMIT.

THESE LIMITATIONS SHALL APPLY TO ANY CLAIM, REGARDLESS OF WHETHER THE LEGAL THEORY IS BASED ON CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, REGULATION, CONSUMER PROTECTION LAWS, OR OTHERWISE, TO THE EXTENT PERMITTED BY LAW.

EXCEPT AS EXPRESSLY STATED HEREIN, EMPOWERED PC MAKES NO REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESS, VERBAL, OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS SOLD BY EMPOWERED PC.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. Any legal action arising out of or relating to this Agreement shall be brought exclusively in the state courts located in Powhatan County, Virginia, or, where federal jurisdiction exists, the United States District Court for the Eastern District of Virginia, Richmond Division.
